Rental Policy & Terms

 

Magic Orlando Vacation Rental welcomes you as a valued guest and wishes to make your stay as enjoyable as possible! Please read the following carefully, it contains information that is primarily for your benefit and all information is copyright protected.

 

The owner offers the short term rental of Magic Orlando Rental, herein reffered to as The Property, to the person of 21 years or over named as the party leader and to the named party members (on the Booking Registration Form), hereinafter reffered to as the guest, under the terms set out below.

 

RESERVATION DEPOSIT & PAYMENT

TO CONFIRM YOUR RESERVATION,  you must be at least 21 yrs of age. A deposit of $220.00 is due to reserve your dates. The remaining balance is due in full 30 days prior to your arrival. If you fail to pay in full 30 days prior to your arrival, your dates MAY become available to other potential Guest and you would be entitle to a refund upon your request under our Cancellation policies. 

 

IF YOU’RE RESERVATION IS MADE WITHIN THIRTY (30) DAYS OF YOUR ARRIVAL DATE, we will require full payment at the time the reservation is made, using any accepted major credit card, as listed below. Should you prefer to pay by check, full payment is also required. Reservation cannot be confirmed until full payment is received.

 

CHECK IN, Check in to the property is after 4:00 pm on the date of arrival as shown on the Booking Registration. (No Early Arrival).

 

CHECK OUT, Check out is on the date of departure as shown on the booking Registration form is 10:00am. In the event that it is found that the guest has not departed the property later than the date of departure or later than the due time, the guest will pay a penalty charge of one day rental.

 

BASIS OF RENTAL, Property is offered for short-term rental. The home is provided on a self-catering basis. The owner provides complimentary starter soap, toilet paper, and trash bags. Once these items are used, it is the Guest's Responsibility to replenish them. Guest would be charged a cleaning fee. The fee includes the house being thoroughly cleaned before your arrival and upon your departure. Daily maid service available at and additional charge.

 

A SECURITY DEPOSIT OF $250.00 IS REQUIRED against any damages or loss that may occur during your stay. The deposit can be made using cash upon check-in, or by check up to (30) days in advance. Charges for any damage or loss will be deducted from your check or cash deposit. The Guest agrees that the Party Leader remains responsible for all loss from the property or its inventory during the Rental Period. The guest will be reimbursed the full amount or any portion thereof after the home has been inspected, should no damage or loss have occurred. This reimbursement will be mailed to your address on file in a timely manner.

The Guest agrees that the owner can charge additional fees to cover:

  • Early arrival or late departure charges.
  • Loss or breakage of inventory items.
  • Damage to the property or its equipment.
  • Unauthorize Pets and Smoking of tobacco products inside property.
  • Failure to remove all trash and belongings brought into the property.
  • Upon departure, failing to leave the home in a reasonable clean condition.
  • GPS navigation system (if requested).  

Where loss or Damage to the Property, the inventory, or equipment exceed $250.00, the owner will bill the Guest for the shortfall, and the Guest agrees to pay within 14 days. In the event that the Guest fails to pay any such shortfall, the Owner reserves the right to exercise any legal remedies to pursue the amount owed from the Guest. Where the owner finds damage or loss to the Property following the Guest departure that in the view of the Owner, constitutes malicious or wanton damage. The Owner reserves the right to notify law enforcement authorities and prosecute in addition to billing the Guest for the full amount of repairs or replacement. The Guest agrees to pay within 14 days.  

 

PETS, Pets are not permitted in the property. In the event that the guest brings a pet to the property. The owner will levy the full amount of the security deposit to pay for additional sanitation and cleaning on the departure of the Guest and Pet.

 

SMOKING: There would be absolutely no smoking in the house. Smoking would be permitted only in the front of the home. Cigarette butts should be discarded in the trash containers located in the garage and not tossed on the property or in the house trash containers. Any traces of smoking in the house would be grounds for forfeiting your entire deposit for additional sanitation and cleaning on departure of the guest.

DATE CHANGE REQUESTS

ANY REQUEST TO CHANGE a confirmed reservation date change is subject to availability, however, we will do our best to accommodate you whenever possible.

HOLIDAY'S DATES RENTAL CANCELLATIONS ARE NOT REFUNDABLE,  these dates a set by owner and is made available only when dates requested.

 

CANCELLATIONS RECEIVED THIRTY (30) DAYS or more prior to your arrival, your deposit of $220.00 would be forfeited. The remaining balance, if any would be refunded.

 

ANY CANCELLATION MADE (30) DAYS or less prior to your arrival date will be refundable at 50% of the full amount.

 

CANCELLATIONS MADE WITHIN THREE WEEK  PERIOD immediately prior to your arrival date are ineligible for any form of reimbursement.

 

***PLEASE NOTE THAT POOL HEAT IS NOT INCLUDED IN THE PRICE OF THE HOME.  PLEASE SEE OPTIONAL SERVICES FOR POOL HEAT CHARGES AND OTHER INCIDENTAL CHARGES ***

 

SERVICE LEVEL, The Owner makes all reasonable efforts to maintain the Property and its equipment in good working order. Wherever commercially possible, repairs are performed within 24 hours, but delays are inevitable. No Refunds are granted for malfunctioning mechanical or electrical equipment including (but not limited to): inoperable appliances, air condition units, swimming pool. No refunds will be given for unfavorable weather, early departure, utility service interuption, construction, or maintenance issues. Additionally, there are no refunds for faulty recording or playback equipment, TV's, audio, telecoms, or cable reception.  

 

THE SWIMMING POOL, Please observe any signs posted in the vicinity of the pool. Pools can be great fun; however can pose a risk, especially to children. Our aim is to give you a perfect vacation, so please ensure the safety of any children staying in the property. 

 

The swimming pool is used at your own risk. It is the responsibility off all Guest to see children and Non-swimmers are not left unattended. There is to be strictly no diving in the pool for safety reasons. There is to be no running around the pool edge in case of slippery surfaces. Please note that the surfaces leading onto the pool area from the villa are tiled and these can also become slippery when wet. We  DO NOT accept laibility for any loss, injury or death.

 

To avoid any accidents from glass, only plastic-ware is to be used at the pool-side. This is provided specifically for this purpose. If glass is broken in the pool a significant charge may be made for the draining and refilling of the pool along with repairs to any damage to pool machinery.

 

POOL HEATER, Once turned on takes approximately 24 hours to bring pool to desired setting. The Owner does not accept liability for failure of Pool heat to provide adequate heating where outside air temperature drops below 55 degrees Fahrenheit. Under such conditions the pool heat is outside the Owner's control, and is regarded as an act of nature and there will be no refunds/reimbursements of pool heater payments if this should occur. 

 

GPS NAVIGATION, A GPS navigation system is available to the Guest during their stay. This rule as been established to protect the interest and preservation of the GPS unit.  Any reservation booked prior to 05/16/2007, the Guest would be required to initial and sign and updated Term and Agreement through the Owner. There would be no exception to this Rule. The GPS would be given to the Guest in 100% working condition. The GPS unit includes the unit, car charger, AC charger, dash/windshield mount, quick user instructions and packaging. It is the Guest responsibility to assure that the unit is in working condition and if any visual damage. The GPS should not be left in motor vehicle visible to the general public when motor vehicle is left parked or unattended. Magic Orlando Rental, its Owner and Management staff are not responsible and would not be held liable for the improper use of the GPS unit by the guest should any damage to property, accident, injury or death occur. Please read all manuals provided. The GPS must be stored in a location to prevent accidental damage. Additionally, there would be and additional $100.00 added to the Guest required $250.00 Refundable Security Deposit. The Security Deposit would now amount to $350.00 that would be used to satisfy the cost of replacing a lost, stolen, damage beyond repair, liquid damage, cracked or scratched screen, missing package or included contents. All other agreements pertaining to Security Deposit also applies and would be deducted from the $350.00 should any incidental occur.

 

INSECTS, There is an abundance of insects in florida due to the tropical climate. the property is treated on a regular basis to prevent problems. However, insects may find their way into the property and are best eradicated using appropriate sprays. Guest are requested to close doors and used the screens provided. Ensure also that leftover food and other waste are disposed of promptly.

 

OWNER/MANAGEMENT COMPANY ACCESS, The Owners or the Management Company may enter the Property at anytime, with or without notice, for the purposes of protection and /or maintenance of the Property. Wherever possible, notice will be provided to the guest prior to such entrance.  

 

PROPERTY RULES, The actions of all members of your party should not interfere with the enjoyment of other holidaymaker or vacationers. Please observe the following:

  • Please do not play loud music or engage in any activity that may cause inconvenience to your neighbors after 10:00 pm in the evening or early in the morning.
  • No small fires or portable cooking equipment, including charcoal BBQ's may be used on the property.
  • Please do not set the air-condition to an unreasonable temperature. Doing this can cause icing within the unit and ultimately failure which is a costly repair. If this should happen during your stay you may be held responsible for the repair of the unit.
  • In the event that any member of your party behaves in a way that is likely to cause distress, danger, annoyance or complaint to any other holidaymaker, or damage to any property, the Owners or their Management Company reserve the right to terminate your rental agreement immediately. The Owners or their Management Company will not be liable for any costs you will incur, nor shall we pay any compensation, nor make any refunds due to this action. 
  • Please do not sit or lounge on the indoor furniture with wet garments on, or if you have sun protection lotion on that may stain the furnishings.
  • Sufficient linen and towels are provided in the home to accommodate 8 Guest. Linen and towels that have been removed from the closet should not be placed back into the closet if used in anyway! Dirty linen should be placed in the hamper located in the garage. Wet towels should be air dry and place in the hamper located in the garage.
  • Please help us by doing your part in the conservation of energy. This would help in keeping our home affordable to you and other guest. 
  • This list is not exhaustive and may be updated or revised as deemed necessary and will be communicated in the welcome book.

LIABILITY DISCLAIMER, The Owner makes all reasonable effort to provide advice and safety information. It is the responsibility of the Guest to ensure that they have read and understand the contents and advice given following arrival at the property. In addition, the Owner states the following:

  • The Owners and Management Company of the property accept no liability whatsoever for death, personal injury, accidents, loss or damage to persons or personal belongings however caused. The use of all accomoditions and amenities including the pool is entirely at the user's own risk. The Guest must ensure that they have adequate insurance coverage.
  • The Owners and the Management Company cannot accept responsibility for the sudden failure of Property equipment, but will take immediate reasonable action to rectify any such failure upon notification by the Guests.
  • If the pool heater cannot reach optimum temperature due to any adverse cold weather conditions the Owners or the Management Company does not accept liability.
  • Provided at the property are a selection of pool accessories. Their use is strictly at the guests own risk. Parents must use their discretion before allowing children to use any toys or equipment as suitable for their age. We cannot accept any responsibility for accident or injury from their use.
  • The Guest must ensure that children are supervised at all times. It is the policy of the Owner that all children under the age 18 years are not left in rental accommodations unsupervised during the rental period.
  • Failure to comply with any of the terms herein will, at the sole discretion of the Owner or Management Company, result in the eviction of the Guest from the property, without recompense or refund.

ACCEPTED METHODS OF PAYMENT
We accept payment through VISA, MASTERCARD, AMERICAN EXPRESS, DISCOVER CARD and PERSONAL CHECKS. A personal check will be accepted only for those reservations made thirty(21) days in advance. Cash is also accepted at the time of check-in during normal business hours, for security deposit only.

NOTICE TO OUR GUEST: This property is privately owned and the management company and homeowner reserve the right to refuse service to anyone, and will not be responsible for accidents or injury to guest, occupants, loss of money, jewelry or valuables of any kind.
